1. Official Site

The official website for Standout Superstar is standoutsuperstar.com. This is the only authorized platform for registration, payments, video submissions, viewing live performances, and all services described herein. Any other website, application, or service claiming to represent Standout Superstar is unauthorized and not affiliated with us. We are not responsible for any losses, damages, or liabilities arising from your use of unauthorized sites or services.

2. Acceptance of Terms

By accessing or using standoutsuperstar.com ("the Site"), registering an account, making a payment, submitting content, or using any services provided, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Site. We reserve the right to modify these Terms at any time. Continued use constitutes acceptance of updated Terms.

3. Description of Service

Standout Superstar is an entertainment platform that allows individuals ("Contestants") to pay for a 15-minute time slot to have their pre-recorded performance video aired to a public audience. Audience members ("Viewers") may watch performances, vote, and — with a paid subscription — send messages to Contestants. The platform also features a $STAR utility token for enhanced platform interaction.

4. Registration and Fees

  • Registration fee: $25.00 USD (non-refundable)
  • Video submission fee: $85.00 USD (due upon video submission, non-refundable once video is submitted for review)
  • Viewer subscription: $9.99 USD/month (cancel anytime)
  • All payments are processed via Stripe. Standout Superstar does not store your payment card information.
  • Fees are subject to change. Current fees are displayed at the time of transaction.

5. Refund Policy

Registration fees ($25) are non-refundable. Video submission fees ($85) are non-refundable once your video has been submitted for review. If your video is rejected for violating content guidelines, no refund will be issued. If the platform is unable to air your video due to a technical failure on our end, we will offer a credit for a future slot at our sole discretion. Viewer subscription fees are non-refundable for the current billing period but you may cancel to prevent future charges.

6. Content Guidelines

By submitting a video, you represent and warrant that:

  • You own or have all necessary rights to the content
  • The content does not infringe any third-party copyrights, trademarks, or other intellectual property rights
  • The content does not contain illegal activity, hate speech, explicit sexual content, extreme violence, harassment, or threats
  • The content does not promote illegal substances, weapons, or dangerous activities
  • You are at least 18 years of age or have parental/guardian consent

We reserve the right to reject, remove, or refuse to air any content at our sole discretion, without refund. We are not obligated to provide a reason for rejection.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STANDOUT SUPERSTAR, ITS OWNERS, OPERATORS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, revenue, data, or business opportunities
  • Any damages arising from your use of or inability to use the Site or services
  • Any damages arising from unauthorized access to or alteration of your account or data
  • Any damages arising from the conduct of any third party on the Site
  • Any damages arising from content submitted by Contestants or messages sent by Viewers
  • Any technical failures, interruptions, or downtime of the platform
  • The outcome or reception of any performance aired on the platform
  • Any interaction between Contestants and Viewers, whether on or off the platform

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

8. Disclaimer of Warranties

THE SITE AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or secure. We do not warrant that any content will be accurate, complete, or current. We do not guarantee any specific number of viewers, votes, or level of audience engagement for any performance.

9. Indemnification

You agree to indemnify, defend, and hold harmless Standout Superstar and its owners, operators, officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Site or services; (b) your violation of these Terms; (c) your violation of any rights of a third party; (d) any content you submit; or (e) any messages you send through the platform.

10. Intellectual Property

Contestants retain ownership of their submitted content. By submitting content to Standout Superstar, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content on the platform, our YouTube channel, and associated social media accounts for the purpose of operating the service. All Standout Superstar branding, logos, design elements, and platform code are our exclusive property.

11. $STAR Token

$STAR is a utility token for use within the Standout Superstar platform. It is not an investment, security, or financial instrument. No guarantees of value, returns, or price appreciation are made or implied. Token value may go to zero. Only purchase what you can afford to lose entirely. Standout Superstar is not responsible for any financial losses related to the $STAR token. Cryptocurrency involves significant risk. You are solely responsible for compliance with applicable tax and regulatory requirements in your jurisdiction.

12. Messaging and Subscriber Content

Subscribers may send text messages and GIFs to Contestants through the platform. Standout Superstar is not responsible for the content of messages sent by users. We reserve the right to moderate, filter, or remove messages at our sole discretion. Harassment, threats, hate speech, and illegal content are prohibited and may result in immediate account termination without refund.

13. Account Termination

We reserve the right to suspend or terminate any account at any time, for any reason, at our sole discretion, with or without notice. Grounds for termination include but are not limited to: violation of these Terms, fraudulent activity, abusive behavior, chargebacks, or any conduct we deem harmful to the platform or its users. No refunds will be issued upon termination for cause.

14. Privacy

Your use of the Site is also governed by our Privacy Policy. By using the Site, you consent to the collection and use of information as described therein.

15. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Standout Superstar regarding the use of the Site and services and supersede all prior agreements and understandings.
